Constructing residential properties is a task that has many different and equally important aspects. Not only do clients have to consult with architects, and local councils, but they must also ensure that the physical construction of the structure itself can be done safely given the terrain and surrounding areas. Taking into account the location of driveways, trees, sewage systems, and other factors must be completed by a qualified Surveyor. They must be carried out before any design for a new residential property construction and should be considered for any type of property renovation.

Topographical surveys show buildings and other structures, spot levels and contours to Australian Height Datum, location of trees, driveways, fences and retaining walls, drainage, sewer and other services including invert levels, kerb heights, floor and ridge heights, fire hydrants, the location of adjoining buildings, as well as any other visible features on site.

Identification Survey

Identification surveys are carried out to define & establish property boundaries. It is important for all property owners to ensure that their land ownership rights are protected. Knowing where your property boundaries extend and checking that they are not encroached upon by neighbouring properties is a good step towards being aware of what you own. A Cadastral Land Surveyor can mark your property boundaries and provide you with piece of mind before you finalise that purchase, or simply to ensure your new fence goes up in the correct location. All too often people trust that their solicitor will be able to uncover any unwanted issues associated with the block of land they are purchasing. Without a survey, you run the risk of not discovering an encroachment which could impact on the use of your land, hence proving to be very costly. Some common identification surveys we get asked to do are:

  • Marking of boundaries for new fencing or building work;
  • Checking for building encroachment issues;
  • Resolving disputes with neighbours over land boundaries; and
  • to confirm the ownership of trees on and close to boundaries.

You may need an identification survey if you are purchasing property. Your conveyancer or solicitor will normally seek out an up-to-date survey which would then be necessary to obtain a building certificate. A building certificate is valid for seven years and ensures the property on the land is clearly defined and will be yours to enjoy without problems.

Torrens Title Subdivision & Strata Title Subdivision

A Torrens Title property is one in which the purchaser owns both the house and the land on which it is built.  This is the most traditional form of ownership and means that you become the sole owner of the property (aside from the bank or financial institution providing the mortgage!) and  you are responsible for the property’s upkeep – both inside the property and outside on the block of land.

A property such as a villa, townhouse or unit however is usually purchased under Strata.  When you buy one of these properties, there are ‘common areas’ that are used by all of the people living in the complex or apartment block including driveways, gardens and so on .  These common areas have to be maintained by all of the unit owners collectively, through an Owners Corporation, because they are shared.  The individual owner is solely responsible for the upkeep of the inside of their property, but they must also share the expense of maintaining the common areas.

A Torrens Title subdivision is the most common method for recording and registering land ownership for residential land in Australia. When a Torrens Title is issued, one larger lot of land has been divided into two or more separate, single and protected land titles.

When a residential property subdivision occurs in this way, the respective owner gets full autonomy over their own land and doesn’t, for instance, have to answer to Strata Managers or Strata rules. This means that each lot of land is completely independent from the other, usually with no shared facilities.

The Strata Plan is a subdivision of a parcel of Real Property Land into separate lots and common property. The Scheme is a building or collection of buildings where the property that each individual owns is called a “lot” and the owners share ownership and responsibility for the “common property.” Strata Schemes are self-governing communities operating as a democracy, where the owners decide collectively how to best manage the property they share. Under the Strata Schemes Management Act 2015, each lot owner has the right to vote on decisions affecting the strata scheme. Equally, the owners have responsibilities, like sharing the costs for the maintenance of the common property.

The Strata Plan

The Strata Plan shows the layout of the Strata Scheme and the extent and nature of the Strata lots. The Strata Plan must be prepared to comply with current legislation including:

  • Strata Schemes Management Act 2015
  • Strata Schemes Management Regulation 2016

Strata Plans are plans subdividing land. Only a Surveyor registered with the Board (BOSSI) can prepare Strata Plans.
